Abstract

El presente comentario realiza un recorrido por las principales sentencias en materia de seguridad y salud laboral. En los últimos meses, se han sucedido diversos pronunciamientos sobre las implicaciones de las limitaciones psicofísicas y la posibilidad de proceder al despido por ineptitud sobrevenida. Existen también varios pronunciamientos sobre las medidas preventivas en caso de acoso, la activación del protocolo y las actuaciones necesarias para garantizar la confidencialidad. Destaca también la interpretación en clave extensiva del concepto de accidente de trabajo in itinere para incluir también la bicicleta como un medio apto de locomoción. En materia de reparación por daños y perjuicios se produce un importante pronunciamiento sobre las consecuencias del fallecimiento del trabajador antes de la fijación de la indemnización. Asimismo, se han suscitado demandas individuales de reparación por daños y perjucios por la falta de adopción de medidas preventivas durante la pandemia.

This commentary takes a look at the main rulings on occupational health and safety. In recent months, there have been several rulings on the implications of psychophysical limitations and the possibility of dismissal due to supervening unfitness. There are also several pronouncements on preventive measures in the event of harassment, the activation of the protocol and the necessary actions to guarantee confidentiality. Also noteworthy is the extensive interpretation of the concept of work‐related accident in itinere to also include the bicycle as a suitable means of locomotion. In the area of compensation for damages, there is an important pronouncement on the consequences of the death of the worker prior to the fixing of compensation. There have also been individual claims for damages for failure to take preventive measures during the pandemic.
