Abstract

La reforma laboral de 2021 mantiene prácticamente inalterado el régimen jurídico laboral de las contratas y subcontratas. Tan solo contiene dos novedades de ruptura: una, orientada a evitar la temporalidad, lo que se intenta conseguir encauzando la contratación de personal a la figura del contrato fijo discontinuo; y otra, que mira a corregir la situación de desigualdad que sufren las personas trabajadoras de las empresas contratistas o multiservicios con relación al personal de la empresa principal, mediante la eliminación de la prioridad aplicativa del convenio de empresa en materia salarial. En este artículo se presta especial atención a la eficacia de las nuevas medidas de contratación laboral de cara a evitar la situación de precariedad de estos trabajadores, y se aclara la polémica cuestión del convenio colectivo aplicable. En síntesis, se mantiene, por un lado, la tesis de que, aun mejorando la situación de estabilidad de los trabajadores, no desaparecen algunos vestigios de precariedad; y, por otro lado, que la función garantista de la norma (nuevo art. 42 .6 ET) no puede circunscribirse a la aplicación del convenio colectivo de sector de la actividad desarrollada por la empresa contratista o subcontratista sino a la que resulte atendiendo a la actividad desarrollada por la empresa principal.

The labor reform of 2021 maintains practically unchanged the labor legal regime of contracts and subcontractors. It only contains two breaking novelties: one, aimed at avoiding temporality, which is intended to be achieved by directing the hiring of personnel to the figure of the permanent discontinuous contract; and another, which seeks to correct the situation of inequality suffered by workers in contractor or multi-service companies in relation to the staff of the main company, by eliminating the application priority of the company agreement in salary matters. In this article, special attention is paid to the effectiveness of the new labor contracting measures in order to avoid the precarious situation of these workers, and the controversial issue of the applicable collective agreement is clarified. In short, on the one hand, the thesis is maintained that, even if the stability situation of workers improves, some vestiges of precariousness do not disappear; and, on the other hand, that the guarantor function of the norm (new art. 42 .6 ET) cannot be limited to the application of the collective agreement of the sector of the activity carried out by the contractor or subcontractor company, but to the one that results according to the activity carried out by the main company.
