Medicina personalizada y uso secundario de datos de salud para fines de investigación: algunas cuestiones

Abstract

El trabajo aborda el dilema jurídico que plantea el nuevo paradigma de la medicina personalizada, cuyo desarrollo requiere disponer de ingentes cantidades de datos de salud, sin merma de su protección como derechos especialmente sensibles conforme al RGPD y de la LOPDPGDD. Se analiza de forma crítica el vigente marco normativo, fragmentado y deficiente, en lo que respecta al uso secundario de los datos de salud para fines de investigación, que culmina en el RPD y trata de conciliar los intereses en conflicto regulando como bases legitimadoras el consentimiento y otras fundamentadas en el interés social o general. Entre otras soluciones, se propone el refuerzo de los mecanismos de garantía para los derechos del titular y el interesado (singularmente: anonimización y seudonimización), a fin de evitar o minimizar en lo posible la materialización de riesgos para los derechos individuales de las personas.

The paper analyzes the legal dilemma derived from the new paradigm of personalized medicine, whose development requires having enormous health data, without prejudice to their protection as particularly sensitive personal rights to which the regulation of the GDPR and the LOPDPGDD applies. The current regulatory framework, fragmented and deficient, which culminates in the DPO, is critically analyzed, with regard to the secondary use of health data for research purposes, which tries to reconcile individual rights and scientific progress by regulating consent and others such as the social or general interest as principles of legitimation of data processing. It is proposed to strengthen the guarantee for the rights of the owner and user of personal health data.
