Abstract

El presente trabajo se enmarca en el Proyecto de la Agencia Estatal de Investigación (AEI) PID2020-118854GB-I00 sobre Instrumentos normativos preventivos en la lucha contra el fraude y la corrupción, del que son IP Inés Olaizola Nogales y Hugo López López. Además, esta publicación se ha elaborado en el marco del proyecto de investigación "Repensando el modelo de sanciones penales: de la entropía a la ordenación sistemática de las respuestas frente al delito (REPENSANCIONES)" (referencia SI3/PJI/2021-00222, IIPP: Daniel Rodríguez Horcajo y Gonzalo J. Basso), financiado por la Consejería de Ciencia, Universidades e Innovación de la Comunidad de Madrid (V-PRICIT) y la Universidad Autónoma de Madrid a través de la Convocatoria 2021 de ayudas a Proyectos de I+D para jóvenes investigadores de la Universidad Autónoma de Madrid.

En los últimos años se ha extendido el interés por estudiar las posibilidades de la justicia restaurativa en los delitos socioeconómicos e implementar itinerarios y programas que atiendan a esos delitos desde el ideal restaurativo. En este trabajo se abordan las cuestiones más problemáticas y las oportunidades de la respuesta restaurativa exclusivamente de la corrupción pública desde el inicio del procedimiento hasta la ejecución de la pena. Se parte de la confianza en los procesos restaurativos para afrontar los delitos que se enmarcan en el concepto de corrupción pública y se propone un modelo mixto (complementario y alternativo) de respuesta que aporte riqueza al abordaje de este fenómeno en el marco de sociedades democráticas.

In recent years there has been a growing interest in studying the possibilities of restorative justice in socio-economic crimes as well as in implementing itineraries and programmes that address these crimes from the restorative ideal. This paper addresses the most problematic issues and opportunities for a restorative response exclusively to public corruption from the beginning of the proceedings to the execution of the sentence. It is based on the confidence in restorative processes to deal with crimes that fall under the concept of public corruption and proposes a mixed model (complementary and alternative) of response which enriches the approach to this phenomenon in the framework of democratic societies.
