Olvido oncológico: protección de datos de salud y no discriminación

Abstract

La tipificación del 'derecho al olvido' en el art. 17 del Reglamento General de Protección de Datos supuso la consolidación de un nuevo baluarte para la privacidad de la persona y tutela de sus intereses frente a informaciones pasadas. En este contexto el 'derecho al olvido oncológico' emerge como una medida singular. Ligada al tratamiento de datos de salud atinentes al cáncer superado, persigue acotar las limitaciones impuestas en el mercado en el acceso a la contratación. El reconocimiento de esta realidad en la Resolución del Parlamento Europeo de 16 de febrero de 2022 y su tipificación legal por algunos países de la Unión Europea han impulsado un movimiento normativo, al que se ha sumado recientemente España, en el que se aboga por la no discriminación en la contratación para quienes han curado de la enfermedad.
