Deslocalización empresarial y reintegro de subvenciones en Navarra

Abstract

La Ley Foral 18/2020, de 16 de diciembre, sobre medidas a favor del arraigo empresarial y contra la deslocalización, ha tratado de prevenir que las empresas afincadas en la Comunidad Foral incurran en deslocalización. El objetivo último de la Ley Foral es que las empresas que reciban subvenciones y ayudas públicas de la Administración Foral Navarra hagan un aprovechamiento de dichos medios de fomento que redunde en una contribución al desarrollo social y económico de la Comunidad Foral, y trata, además, de evitar que las empresas trasladen sus domicilios sociales y centros de trabajos fuera del territorio navarro. El presente trabajo contiene un comentario crítico de dicha Ley Foral y apunta algunas líneas en las que podría basarse una futura revisión de su articulado, con el objeto de contribuir a su mejora.

Foral Law 18/2020, of December 16, on measures in favor of business roots and against relocation, has tried to prevent companies based in the Foral Community from relocating. The ultimate objective of the Foral Law is that companies that receive subsidies and public aid from the Navarra Foral Administration make use of said means of promotion that results in a contribution to the social and economic development of the Foral Community, and also deals with to prevent companies from moving their registered offices and workplaces outside Navarrese territory. This paper contains a critical commentary on said Ley Foral and points out some lines on which a future revision of its articles could be based, in order to contribute to its improvement.
