The offences of trespassing a private home, the domicile of a legal person and that of a public establishment (arts. 202 to 204 CP, and 490.1 CP), and unconstitutional and illegal execution of the official entry or search at the domicile (art. 534.1 CP) are analyzed. and its development in the present and future LECrim) in light of the object and content of art. 18.2 EC. It is verified that the crime of trespassing protects the autonomy of the will in the area of spatially localized privacy. It does not ensure the inviolable physical space (art. 18.2 CE) but the place of private life (art. 18.1 CE). The link between the owner's freedom of exclusion and the privacy of the spatial sphere reveals the insignificance of the enumeration of the spaces raided by their title of belonging (natural or legal person), nature (public or private), purpose of their activity (service to the public) or a state of inviolability (during closing hours).
Se analizan los delitos de allanamiento de morada, domicilio de personas jurídicas y establecimiento público (arts. 202 a 204 CP, y 490.1 CP), y de ejecución inconstitucional e ilegal de la oficial entrada o del registro en el domicilio (art. 534.1 CP y su desarrollo en la LECrim presente y futura) a la luz del objeto y contenido del art. 18.2 CE. Se verifica que el delito de allanamiento protege la autonomía de la voluntad en el ámbito de privacidad espacialmente localizado. No asegura el espacio físico inviolable (art. 18.2 CE) sino el lugar de vida privada (art. 18.1 CE). La vinculación de la libertad de exclusión del titular a la privacidad del ámbito espacial revela la intrascendencia de la enumeración de los espacios allanados por su título de pertenencia (persona física o jurídica), naturaleza (pública o privada), finalidad de su actividad (atención al público) o un estado de inviolabilidad (en horario de cierre).
