Este trabajo aborda la preeminencia excesiva del poder ejecutivo en el marco de los Presupuestos prorrogados, especialmente llamativa cuando hay que cumplir los objetivos de estabilidad presupuestaria y sostenibilidad financiera. Aunque parte de la situación de Navarra, se han tomado ejemplos del Estado y de otras Comunidades Autónomas, así como la doctrina del Tribunal Constitucional, para proponer las reformas oportunas en nuestra legislación a fin de evitar situaciones donde Gobiernos en minoría deciden unilateralmente sobre los acuerdos de no disponibilidad presupuestaria. Asimismo examinamos las reglas de publicidad y transparencia de estos acuerdos.
This paper deals with the excessive prominence of executive power within the framework of carried over budgets, especially striking when it comes to the goals of budgetary stability and financial sustainability. Although it is based on the location of Navarra, examples of State and other autonomous communities, as well as the doctrine of the Constitutional Court, have been taken to propose appropriate reforms in our legislation in order to avoid situations where minority governments decide unilaterally on the agreements of non-budgetary availability. We also examined the rules of publicity and transparency of these agreements.
