Los sistemas de relaciones cooperativas: una perspectiva de Derecho comparado desde el sistema tributario español

Abstract

Durante los últimos años se están desarrollando en algunos ordenamientos jurídicos sistemas en los que la relación entre la Administración tributaria y las empresas, inicialmente las multinacionales, se plantean más en el plano de la cooperación y la confianza mutua que en el de la confrontación, tratando así de mejorar las cifras de recaudación y reducir la litigiosidad tributaria; adelantándose a la generación de los conflictos por la vía de la colaboración. Estas fórmulas se han dado en denominar Enhanced Relationship y, últimamente Co-operative Compliance. Los países que han liderado este movimiento son Australia, Países Bajos y Reino Unido. La IFA abrió un foco de discusión sobre este particular1, convocando un seminario específico sobre el tema en su congreso anual del año 2012, en Boston2. La OCDE, por su parte, ha liderado esta política fiscal elaborando varios documentos -el último de más señalada importancia en 20133- sobre el particular. Este cambio de modelo en las relaciones entre las Administraciones tributarias y los contribuyentes, que trasciende el estrecho ámbito -en el que ha nacido- de lo relativo a las grandes empresas, plantea problemas específicos y retos organizativos de entidad. El propósito de este documento es llevar a cabo un análisis de estas iniciativas -en particular de las experiencias británica y holandesa- desde la perspectiva de su eventual adaptación a la realidad española.
