Medidas cautelares y arbitraje

Abstract

Con la aprobación de la Ley de Enjuiciamiento Civil 1/2000, el ordenamiento jurídico español incorporó por primera vez la posibilidad de solicitar medidas cautelares en el contexto del arbitraje, fortaleciendo así la eficacia y credibilidad de este mecanismo alternativo de resolución de conflictos. La posterior Ley 60/2003 de Arbitraje no solo confirmó esta facultad judicial, sino que fue más allá al reconocer también la competencia de los propios árbitros para adoptar tales medidas, alineando la normativa española con las tendencias internacionales más modernas en materia arbitral. Esta obra analiza en profundidad el marco jurídico vigente, abordando desde una perspectiva eminentemente práctica las diferentes cuestiones que pueden surgir en torno a la solicitud y adopción de medidas cautelares en el arbitraje. El estudio distingue entre aquellas medidas que pueden ser dictadas por los jueces y las que están al alcance de los árbitros, con el fin de asegurar la futura ejecución del laudo y garantizar la efectividad del procedimiento arbitral en su conjunto.
