El tratamiento de las situaciones de sobreendeudamiento en los Estados Unidos

Abstract

El presente artículo examina el modelo norteamericano de tratamiento de las situaciones de sobreendeudamiento de los particulares. Se desarrollan las particularidades de los dos procedimientos especialmente previstos para personas físicas: El de liquidación previsto en la Sección 7 del Bankruptcy Code (BC), así como el procedimiento de reajuste de pagos, regulado en la Sección 13 BC. A su vez, se incide en los efectos comunes que produce la iniciación del concurso, especialmente en cuanto se refiere al “automatic stay”, o suspensión automática, así como también en la cancelación de las deudas pendientes que se produce como consecuencia de la conclusión del proceso concursal, como mecanismos de protección del “deudor honesto pero desafortunado”. Asimismo, se resaltan algunas de las reformas legislativas que se han producido en los últimos años, evidenciando una tendencia hacia una restricción normativa a la hora de poder acudir al procedimiento de liquidación, así como un endurecimiento de las exenciones de las deudas cancelables.
