La resolución del contrato es una alternativa a la facultad de exigir el cumplimiento que se da en contratos bilaterales con obligaciones recíprocas. Si quien ha cumplido o está dispuesto a cumplir continúa interesado en el mantenimiento de la obligación de la contraparte, solicitará su cumplimiento. Si, por el contrario, pierde el interés, la ley le faculta para resolver el contrato. La consecuencia es que la parte que resuelve no solo exime a la contraparte de cumplir con su obligación, sino que también se exime ella de cumplir su propia deuda. Es decir que cada contratante queda dispensado de su propia obligación?
