Revisión de la sentencia firme en el proceso penal

Abstract

La revisión de la sentencia firme en el proceso penal ha sido configurada como un medio de impugnación autónomo, a través del cual se pretende la rescisión de las sentencias firmes pertenecientes a la jurisdicción penal, a partir de la concurrencia de alguno de los motivos descritos en el art. 954 LECrim. El fundamento de la revisión descansa en la búsqueda de la justicia material, a través de la impugnación de aquellas sentencias que han ganado firmeza, pero sobre las cuales se aprecia, posteriormente, alguna circunstancia que, de apreciarse, conllevaría la nulidad de esta resolución judicial o la imposición de una sentencia menos grave. Esta obra se centra en el análisis pormenorizado del proceso de revisión de la sentencia firme penal, desde sus orígenes y hasta su regulación actual; prestando especial atención a la reciente reforma sobre los motivos de revisión y la problemática que presentan la tramitación de su procedimiento y el resarcimiento del injustamente condenado, cuando la sentencia en sede de revisión le es favorable.
