Impunidad

Abstract

La impunidad no es sólo la falta de castigo sino que también conlleva la falta de investigación, y de procesamiento de los responsables de los delitos, lo cual impide a las víctimas saber la verdad sobre los hechos, conocer a los autores así como obtener una reparación adecuada al daño sufrido. La impunidad puede ser de hecho o de derecho aunque sus efectos son los mismos. La cuestión de la impunidad se ha planteado sobre todo en torno a las graves violaciones de derechos humanos cometidas durante un conflicto armado o régimen autoritario, a las cuales debe hacer frente el Estado en situación de postconflicto o de transición hacia un Estado de derecho basado en el respeto de los derechos humanos. En este sentido, la creación de tribunales penales internacionales ha contribuido a hacer justicia y juzgar a los responsables de estos crímenes, aunque es preferible que lo haga el Estado en donde ocurrieron los hechos. Si bien las amnistías o medidas equivalentes se consideran inadmisibles en el derecho internacional cuando impiden investigar, juzgar y castigar a los autores de graves violaciones de derechos humanos, en la práctica los Estados han seguido adoptando este tipo de medidas u análogas que promueven la impunidad.
