Abstract

This article analyzes the position of the considered accomplice in the qualification section of the insolvency proceeding, specifically in terms of precautionary measures. Articles 18 and 133 of Royal Legislative Decree 1/2020, of May 5, which approves the consolidated text of the Bankruptcy Law, regulate the precautionary measures to ensure the integrity of the debtor’s assets, in the first case, and the eventual condemnation of the bankruptcy deficit, in the second. However, in either scenario, it seems that any precautionary attempt directed against the accomplice will be innocuous. A modification of this article is necessary in order to allow this gap to be filled.
