El mecanismo excepcional de revisión de precios y la doctrina del riesgo imprevisible

Abstract

Este trabajo aborda el análisis de la normativa que aprobó el Gobierno sobre la revisión excepcional de precios como respuesta al contexto de incremento imprevisible y desorbitado de los precios de determinadas materias primas, agravado por la guerra en Ucrania, que ha provocado un incremento notable de los costes de ejecución de muchos contratos públicos. Asimismo, ya no vigente esta normativa, y a la vista de las reclamaciones de los contratistas que no han tenido cabida en tal revisión excepcional, así como la necesaria mejora regulatoria de la LCSP017 en lo relativo a los riesgos en la ejecución de los contratos, se plantea el recurso a la doctrina del riesgo imprevisible como mecanismo extraordinario adecuado para el restablecimiento del equilibrio financiero del contrato siempre que concurran los requisitos exigibles para su aplicación.
