Resolución unilateral del contrato de arrendamiento de vivienda por necesidad del arrendador: una reflexión sobre las bases romanas y su interpretación en las Partidas.

Abstract

La novedad que supuso la constitución atribuida al emperador Caracalla, C. 4, 65, 3, del año 214 DC, por referirse por primera y única vez en las fuentes romanas, como causa de resolución unilateral del contrato de inquilinato, a la necesidad del arrendador de habitar en su propia vivienda arrendada, junto a la asombrosa resonancia que tuvo dicha constitución, por vía del Ius commmune, en el Derecho histórico español hasta el actual siglo XXI, justifica, a mi entender, el objeto de este estudio, que no es otro que el de reflexionar sobre dicho texto jurídico, tal y como se transcribe en el Código de Justiniano y, en particular, sobre su interpretación en las Partidas a la hora de configurar y regular la citada causa de resolución contractual, por ser estas, precisamente, uno de los grandes monumentos del Ius commune.
