Abstract

La Ley 1/2000, de 7 de enero de Enjuiciamiento Civil estableció en los artículos 661, 675 y 704 diversas vías para que los terceros ocupantes de un bien inmueble pudiesen conocer acerca de la existencia de un proceso de ejecución pendiente1 y, de este modo, poder defender en dicho procedimiento su legítima ocupación2. Además, dichos preceptos también permiten al ejecutante y al adquirente de un bien inmueble obtener un pronunciamiento, dentro del mismo proceso de ejecución, en el sentido de que los poseedores del bien en cuestión no tienen derecho a seguir ocupándolo. Los anteriores preceptos fueron una novedad respecto a la anterior Ley procesal, que no preveía ningún incidente en el que los ocupantes de un bien inmueble pudiesen defender en el proceso de ejecución su derecho a ocupar. Lo anterior se pone de manifiesto ya expresamente en la propia Exposición de Motivos de la Ley. Con la vigencia de la Ley de Enjuiciamiento Civil de 1881 era muy frecuente que, una vez transmitido un bien inmueble o al proceder a la entrega de éste en un proceso de ejecución, apareciesen terceros ocupantes que reivindicasen su derecho a seguir ocupando el inmueble.
