El derecho a la pensión de viudedad en casos de poligamia

Abstract

La poligamia, si bien puede resultar ajeno en el mundo occidental, es una realidad que incluso hoy en día se percibe. La inmigración de los distintos trabajadores al territorio europeo, en concreto, a España, ha convertido el tema tratado en este trabajo de fin de grado, en uno de notable actualidad. A través del análisis de las distintas instituciones intervinientes y de la jurisprudencia de nuestros Tribunales, se intentó dar respuesta a la hipótesis planteada: ¿Se reconoce el derecho a la pensión de viudedad en España a los cónyuges supérstites cuando forman parte de un matrimonio poligámico? Se podrá observar que la respuesta a esta pregunta es más bien abstracta y no absoluta, quedando en manos de nuestros tribunales y legisladores, su solución definitiva. Siendo este un supuesto que se puede encontrar en la práctica, resulta de notable utilidad entender las líneas jurisprudenciales que existen al respecto y la perspectiva actual sobre la materia.
