Abstract

[spa] Las tecnologías móviles de salud (apps, wearables), como instrumento al servicio de las personas, pueden ser de gran utilidad en el proceso de envejecimiento saludable. Los dispositivos móviles de salud plantean unos retos jurídicos y éticos, en general, y unos más específicos cuando son utilizados por y para las personas mayores. Este working paper presenta algunos de estos retos, que giran en torno al control de calidad, seguridad y eficacia de los dispositivos móviles, lo cual depende de si es considerado un producto sanitario o no, y a la protección del derecho a la intimidad y la protección de datos.

[cat] Les tecnologies mòbils de salut (apps, wearables), com a instrument al servei de les persones, poden ésser de gran utilitat en el procés d’envelliment saludable. Els dispositius mòbils de salut plantejen uns reptes jurídics i ètics, en general, i uns de més específics quan són utilitzats per i per a les persones grans. Aquest working paper presenta alguns d’aquests reptes, que giren entorn del control de qualitat, seguretat i eficàcia dels dispositius mòbils, la qual cosa depén de si són considerats un producte sanitari o no, i a la protecció del dret a la intimitat i la protecció de dades.

[eng] Mobile health technologies (apps, wearables), as a tool at the service of people, can be very useful in the process of healthy ageing. Mobile health devices pose legal and ethical challenges, in general, and more specific ones when used by and for older people. This working paper presents some of these challenges, which revolve around the quality control, safety and efficacy of mobile devices, which depends on whether they are considered a medical device or not, and the protection of privacy and data protection.
