La ultraactividad de los convenios colectivos

Abstract

[cast] Este trabajo analiza la ultraactividad de los convenios colectivos, centrándose el estudio en el artículo 86.3 del Estatuto de los Trabajadores y, en menor medida, en el artículo 86.2 de la misma norma legal. Tras la Reforma Laboral de 2012, la ultraactividad de los convenios colectivos sufrió un cambio de regulación, de manera que, aunque se logró reducir la petrificación de los convenios colectivos – objetivo que pretendió el legislador –, surgieron nuevos desajustes que hicieron de la ultraactividad de los convenios colectivos una cuestión controvertida en el Derecho del Trabajo. Ante estos desajustes, es transcendental tener en consideración la doctrina jurisprudencial del Tribunal Supremo, pues es esta la que permitirá que la inseguridad jurídica de la que estaba dotada esta institución disminuya considerablemente.

[eng] This project analyses the extended validity of collective bargaining agreements. The study is focused on the article 86.3 of the Workers’ Statute and, to a lesser extent, on the article 86.2 of the same legal standard. After the 2012 Labour Reform, the extended validity of collective bargaining agreements suffered a change of regulation, so that although the reduction of the collective bargaining agreements’ petrification was accomplished – which was one of the main objectives of the legislator –, new issues took place, making the extended validity of collective agreements a more complex matter. In front of these issues, it is transcendental to take into consideration the Supreme Court’s jurisprudential doctrine, so it allows the legal uncertainty which was found in this institution to diminish considerably.
