Abstract

El Projecte de reforma de l’Estatut d’autonomia de Catalunya, aprovat pel Parlament català el setembre de 2005, al marge de la millora del sistema d’autogovern de Catalunya, ha centrat també la seva atenció en la definició del sistema institucional local i ha reprès novament la discussió sobre l’abast del principi d’autonomia local. Des d’aquesta perspectiva, juntament amb la nova regulació de les competències locals, el mencionat projecte de reforma estatutària incorpora nous elements de garantia de l’autonomia local, entre els quals destaca la figura del Consell de Governs Locals. Aquesta nova institució es configura com l’òrgan de representació dels municipis i les vegueries en les institucions de la Generalitat de Catalunya, a la vegada que se li atribueixen funcions de participació en els procediments normatius autonòmics que incideixin específicament sobre les administracions locals. Així doncs, a partir de les previsions del Projecte de reforma de l’Estatut d’autonomia de Catalunya i de les experiències similars que ens ofereix el Dret comparat, aquest estudi realitza una primera aproximació al règim jurídic de la nova institució, i intenta determinar quina és la seva naturalesa jurídica, la seva composició i les principals funcions que el nou text li atribueix.

The proposal for the reform of the Statute of Autonomy of Catalonia was passed by the Catalan Parliament on September 2005. Besides the improvement of self-government of Catalonia, the proposal also tries to define the Catalonia’s local institutional system, taking up again the discussion about the scope of the principle of local autonomy. From this point of view, the proposal incorporates new elements to guarantee the local autonomy, among others, the Council of Local Governments. This new institution appears as the body of representation of municipalities and vegueries in the Generalitat’s institutional framework. At the same time, it is empowered to participate in the regulatory proceedings that affect specifically local administrations. Starting from the proposal for the reform of the Statute of Autonomy of Catalonia, the purpose of this essay is to draft a first approach to the legal system of the Council of Local Governments, trying to determine which are its legal constitution, its composition and its main functions.
