Decomisar sin castigar: Utilidad y legitimidad del decomiso de ganancias

Abstract

El decomiso ampliado y el decomiso sin condena permiten decomisar ganancias delictivas en situaciones en las que no sería legítimo imponer una pena. El objetivo de este trabajo es determinar si el decomiso de ganancias en dichas situaciones es útil y legítimo. En primer lugar, la utilidad del decomiso de ganancias para combatir la criminalidad que opera con fines de lucro se pone de manifiesto a través de su comparación con otros institutos jurídicos que también pueden incidir sobre los beneficios delictivos. Así, se concluye que esta clase de decomiso evita el provecho económico del delito en mejores condiciones que la responsabilidad civilex delicto, la multa, el delito fiscal, el blanqueo de capitales o un eventual delito de enriquecimiento ilícito. A continuación, se aborda la cuestión de su legitimidad, que ha sido puesta en duda por las mismas razones que fundamentan la utilidad del decomiso de ganancias. En este sentido, se ha esgrimido recurrentemente que su regulación no respeta las garantías que deberían rodear el ejercicio del ius puniendi, presuponiendo que dicha institución tiene naturaleza sancionadora. En este trabajo se defenderá, tras delimitar el concepto de sanción, que el decomiso no constituye una manifestación del ius puniendi. Su contenido no supone la imposición de un mal y su fin no es aflictivo. Por ello, se estima legítimo decomisar ganancias delictivas en situaciones en las que no cabría castigar por los delitos que las han originado.
