[eng] The purpose of this legal opinion is to study the procedural and substantive treatment of the jurisdictional and legal protection of the right to the own image in its patrimonial dimension. In order to develop the analysis of positive law in its most casuistic approach, the study is framed in a set of facts based on real and current events that expose the possible illegitimate interference with the right to one's own image by a non-consensual commercial exploitation. This scenario is analysed from the partidist position which shall necessarily be taken by the lawyer, in this case from the position of lawyer of the defendant. From the point of view of this procedural position, issues strictly related to the lawyer's relationship with his client are also addressed. Applicable substantive legislation, procedural rules and jurisprudential doctrine of civil and constitutional orders have been analysed for the resolution of the issues proposed, all taking into account two different points of reference in time: the time period coetaneous to that of the set of facts and the contemporaneous time.

[spa] El presente dictamen tiene por objeto el estudio del tratamiento procesal y sustantivo del ámbito de protección jurisdiccional y legal del derecho a la imagen en su dimensión patrimonial. Con la finalidad de desarrollar el análisis del derecho positivo en su aproximación más casuística, el estudio se plantea enmarcado en un supuesto de hecho basado en hechos reales y de actualidad que exponen la posible intromisión ilegítima al derecho a la propia imagen por explotación comercial no consentida. Este escenario es analizado desde la posición partidista que necesariamente debe tomar el letrado, en este caso desde la posición de abogado de la parte demandada. Desde la óptica de esta posición procesal, se resuelven asimismo cuestiones estrictamente relativas a la relación del abogado con su cliente. Para la resolución de las cuestiones planteadas han sido analizadas legislación sustantiva aplicable, normas procesales y doctrina jurisprudencial de los órdenes civil y constitucional, todo ello teniendo en cuenta dos puntos.
