Abstract

[spa] El Derecho Internacional Humanitario (DIH) previsto en los cuatro convenios de Ginebra de 1949 establece una protección especial para las instalaciones y medios de transporte médicos en tiempos de guerra. Todas las partes en un conflicto deben tomar las medidas necesarias para asegurar que ni el personal médico ni los hospitales u otras instalaciones sanitarias serán atacados. Según este cuerpo jurídico, tan pronto como una persona cae herida, pasa a estar protegida. Carece de importancia cómo resultó herida ni si ha participado en las hostilidades en alguno de los bandos: cuando cesa la lucha ya no es considerado un combatiente y hay que proporcionarle atención médica igual que a un civil. Sin embargo, desde el año 2015 los ataques a hospitales y centros sanitarios han sido una tendencia en alza, lo que socava no sólo el DIH sino los principios fundamentales de la acción humanitaria.
