El artículo parte de las dificultades que experimentan los ciudadanos de países en desarrollo para acceder a medicamentos esenciales, nuevos (protegidos por patente) y de calidad. La entrada en vigor del Acuerdo sobre los aspectos de los Derechos de Propiedad Intelectual relacionados con el Comercio (ADPIC) el 1 de enero de 1995 constituye un factor negativo que agrava este hecho afectando a los ciudadanos de países en desarrollo, y muy especialmente, de países menos adelantados. En efecto, el ADPIC reconoce el derecho de patente, derecho que los Estados parte deben reconocer a los inventores. Partiendo de todo ello, el artículo relaciona, de una parte, el derecho de acceso a los medicamentos, y de otro, el derecho de propiedad del propietario de la invención sobre esta.Finalmente, expone cual es la situación de la patente de sofosvubir en los países en desarrollo.
The article stems from the difficulties that individuals from developing countries experience in respect of access to essential medicines, which are new (under patent protection) and are medicines of quality. The entry into force of the TRIPS agreement in 1 January 1995 represents a negative factor that worsens the situation which affects citizens from developing countries, particularly, those coming from least developing countries. In effect, the TRIPS agreement recognizes the right of the inventor to a patent. State Parties to this convention must recognize, confer and protect this right. This stated, the article attempts to concile the right of Access to medicine with the right of patent.Finally, the article exposes which is the patent situation of the drug sofosvubir in India, the major producer of generic medicines in the world.
