Estudio del sobreendeudamiento, crisis hipotecaria y exclusión social en las familias españolas

Abstract

[spa] La profunda crisis económica que sufre España ha provocado que muchas familias, como consecuencia de la situación de desempleo prolongada en el tiempo, no hayan podido cumplir con sus obligaciones económicas derivadas de los préstamos hipotecarios concertados con las entidades financieras para la adquisición de su vivienda habitual. Esta problemática ha derivado en el incremento de procesos de ejecución hipotecaria de los préstamos bancarios y un aumento familias que quedan privadas de su vivienda habitual y, a pesar de ello, continúan siendo deudores del banco por la cantidad residual no cubierta con el precio de subasta de su vivienda por el acreedor hipotecario. En este trabajo se investiga si los españoles tienen en su Ordenamiento Jurídico respuesta eficiente que evite la exclusión social del deudor sobreendeudado y garantice el derecho constitucional a la vivienda consagrado en el artículo 47 de la Constitución Española de 1978. Investigamos el marco legal, el entorno jurídico-cultural y los datos socio-económicos de la época de crisis inmobiliaria para tratar de conocer si la regulación legal hipotecaria existente en España al inicio de la crisis en 2008 reunía los requisitos mínimos para preservar los derechos fundamentales del consumidor “personal natural” no comerciante sobreendeudado.

[cat] La profunda crisi econòmica que sofreix Espanya ha provocat que moltes famílies, com a conseqüència de la situació de desocupació perllongada en el temps, no hagin pogut complir amb les seves obligacions econòmiques derivades dels préstecs hipotecaris concertats amb les entitats financeres per a l'adquisició del seu habitatge habitual. Aquesta problemàtica ha derivat en l'increment de processos d'execució hipotecària dels préstecs bancaris i un augment de famílies que queden privades del seu habitatge habitual i, malgrat això, continuen sent deutores del banc per la quantitat residual no coberta amb el preu de subhasta del seu habitatge pel creditor hipotecari. En aquest treball s'investiga si els espanyols tenen en el seu Ordenament Jurídic resposta eficient que eviti l'exclusió social del deutor sobreendeudat i garanteixi el dret constitucional a l'habitatge consagrat en l'article 47 de la Constitució Espanyola de 1978. Investiguem el marc legal, l'entorn jurídic-cultural i les dades soci-econòmiques de l'època de crisi immobiliària per tractar de conèixer si la regulació legal hipotecària existent a Espanya a l'inici de la crisi en 2008 reunia els requisits mínims per a preservar els drets fonamentals del consumidor “personal natural” no comerciant sobreendeudat.

[eng] The deep economical crisis going through Spain has caused that many families, as a consequence of the unemployement situation during a long time, have not been able to cope with their economic obligations arising from the mortages with finantial institutions for their main residences. This problem has caused an increase amount of foreclosure of their mortages and an arising amount of families deprived from their main residence and, nonetheless, they still hold a debt with their bank for the amount non covered by the finantial institution auction. This is a research to understand whether the Spaniards have an efficient answer in their legal system to avoid the social exclusion of the overindebteds able to guarantee the constitutional right to adequate housing established in the 47th article of the 1978 Spanish Constitution. Our research analyses the legal frame, the legal-cultural environment and the social-economic data of the real estate crisis in order to understand if the legal mortgage regulation existing in Spain in the 2008 crisis outset was able to provide the minimum requirements to preserve the fundamental rights to the "neutral" not overindebted consumer.
