La Propuesta de Directiva relativa a determinados aspectos de los contratos de compraventa en línea y otras ventas de bienes a distancia

Abstract

Con la estrategia del Mercado Único Digital, la Comisión ha dejado atrás el CESL y, en su lugar, ha desdoblado sus contenidos en dos Propuestas de Directivas, una para el comercio online y a distancia de bienes y otra para el de contenidos digitales, que tienen carácter de máximos. Este artículo es un análisis de la Propuesta de Directiva relativa a determinados aspectos de los contratos de compraventa en línea y otras ventas a distancia de bienes. A pesar de las novedades que aporta, no rompe con los esquemas clásicos a que ya estamos acostumbrados. La norma supone una reelaboración de ciertos aspectos de la Directiva 99/44 y, si llegara a aprobarse, en Europa existiría un doble régimen jurídico para la venta de bienes de consumo, según la contratación fuera presencial o a distancia. Es algo que, desde luego, no contribuye a evitar la fragmentación del mercado interior.

With the Digital Single Market Strategy, the Commission has definitely abandoned the CESL;instead, its contents have been split in two Proposals for Directives, one for online andotherdistancesales ofgoods and the other one forthe supply ofdigital contents. Both are full harmonizationmeasures. This article examines the Proposal for a directive on certain aspects concerning online and other distance sales of goods, which only modifies some contents of the Directive99/44and do not break up with the classics schemes. Shall it be enacted, there would be in Europe a dual legal regime for face-to-face and distance B2C sales. It certainly does not help to avoid fragmentation of theinternal market
