Abstract

A partir de la STC 31/2010, de 28 de junio, el Tribunal Constitucional español ha sido llamado en innumerables ocasiones a pronunciarse sobre la denominada “cuestión catalana”, es decir sobre el marco jurídico de relaciones existentes entre los poderes e instituciones del Estado español, por un lado, y las instituciones de la Comunidad Autónoma catalana, por otro, y la adopción de actos y decisiones (de cariz legislativo, administrativo e incluso judicial) que han visto a ambos como protagonistas agriamente enfrentados. En este contexto, todas las decisiones del Tribunal Constitucional se habían adoptado por unanimidad hasta llegar a la STC 75/2019, de 22 de mayo, la cual representa el ingreso del voto particular en la jurisprudencia constitucional en relación con la “cuestión catalana”. Objetivo de este artículo es reflexionar acerca del contenido de estos votos particulares, así como intentar esbozar algunas consideraciones de carácter sistemático sobre la incidencia de dicho instrumento procesal en controversias en las que Derecho y política están fuertemente entrelazados.

Since judgement STC 31/2010, the Spanish Constitutional Court has been frequently asked to pronounce on the so-called “Catalan question” - which deals with the relationships existing between Spanish and Catalan authorities - as well as on legislative and administrative acts adopted from both sides and sentences passed by Spanish Courts. In this context, unanimity was reached in all the cases submitted to the Spanish Constitutional Court, until judgment STC 75/2019 was pronounced and some dissenting opinions were written thereupon. The aim of this article is to analyse these dissenting voices and try to develop some remarks on the influence that dissenting opinions could have while looking at topics in which legal and political questions cannot be considered one without the other.
