Abstract

Il saggio si pone l’obiettivo di analizzare il licenziamento disciplinare nel settore pubblico, ricostruendo la disciplina di riferimento, evidenziando i profili di criticità e suggerendo possibili soluzioni interpretative. L’enunciato obiettivo involge la preliminare ricostruzione dei profili di specialità del potere disciplinare nel settore pubblico, con particolare riferimento alla sua doverosità di esercizio, e poi si sviluppa approfondendo in via specifica le questioni concernenti il licenziamento, con particolare attenzione alle ipotesi tipizzate dal legislatore e alla loro interpretazione alla luce del principio di proporzionalità, per poi passare ad analizzare il rapporto tra procedimento disciplinare e penale, per concludere con l’approfondimento delle tutele riconosciute al dipendente illegittimamente licenziato, anche in un parallelo con il settore privato.

The essay aims to analyze disciplinary dismissal in the public sector, reconstructing the reference discipline, highlighting the critical profiles and suggesting possible interpreta- tive solutions. The objective statement involves the preliminary reconstruction of the spe- cialty profiles of disciplinary power in the public sector, with particular reference to its du- ty to exercise, and then develops by specifically examining the issues concerning dismissal, with particular attention to the hypotheses typified by the legislator and their interpretation in light of the principle of proportionality, to then move on to analyze the relationship be- tween disciplinary and criminal proceedings, to conclude with the in-depth analysis of the protections recognized to the illegitimately dismissed employee, also in a parallel with the private sector.
