Ratio decidendi e intelligenza artificiale

Abstract

L’articolo guarda all’utilizzo dell’intelligenza artificiale da parte dell’amministrazione pubblica come tema di legittimazione delle decisioni algoritmiche, attraverso il rapporto tra diritto e tecnica, che si presta ad affrontare il tema di quale cultura – se giuridica o tecnica – debba prevalere. Le risultanze algoritmiche rese su innumerevoli casi sono strumento per l’analisi di quella ratio decidendi che si distingue dalla motivazione che di una sentenza o di un provvedimento è fornita. Come noto, un algoritmo può imparare dall'esperienza umana, amplificando la capacità di memorizzare, di ordinare e di classificare decine di migliaia casi, che sono i precedenti applicativi degli enunciati legislativi, così individuando una vicinanza culturale di tale logica con quelle abilità logiche dei giuristi che da tempo rivelano la ratio decidendi a prescindere dagli obiter dicta che fonda la relazione tra fatto e dispositivo.
