Legalidad [principio de]

Abstract

Il lavoro si sofferma innanzitutto sull'origine del principio di legalità, come criterio di correttezza nell'esercizio della funzione amministrativa, negli ordinamenti giuridici dell'Europa continentale, nell'ambito della teorica dello Stato di diritto. Si esamina poi il modo in cui il principio viene recepito e applicato nel diritto canonico, a partire dal vigente codice di diritto canonico. Si sottolineano i diversi ambiti in cui opera il principio per subordinare l'attività amministrativa alla legge, vale a dire la delimitazione delle competenze degli organi amministrativi e la conformità degli atti amministrativi alle fonti di diritto di grado superiore. Si evidenziano, nondimeno le criticità nell'estendere uno strumento formale di garanzia, qual è il principio di legalità, a un ordinamento intrinsecamente elastico come l'ordinamento della Chiesa, ove vigono gli opposti principi di concentrazione dei poteri, di libertà di forma negli atti di governo, di prevalenza della giustizia sostanziale sulla giustizia formale.
