Abstract

Le cœur de la réforme issue du règlement du Parlement européen et du Conseil, du 11 avril 2024, modifiant le protocole n° 3 sur le statut de la Cour de justice de l’Union européenne est, c’est une évidence, le transfert d’une partie de la compétence préjudicielle au Tribunal. Ce transfert entraîne avec lui une modification accessoire mais véritablement révolutionnaire pour la pratique du Tribunal : l’obligation de désigner un avocat général pour toute demande de décision préjudicielle traitée par cette juridiction. Cette contribution envisage les implications de cette obligation.
