Derecho a la vivienda y reformas estatutarias

Abstract

[Resumen] A partir de la segunda mitad de los noventa ha tenido lugar una subida espectacular de los precios de la vivienda, lo que ha supuesto la imposibilidad de satisfacción del derecho social a disfrutar de una vivienda digna y adecuada por parte de la ciudadanía. La vivienda es una necesidad básica de las personas y, por tanto, los poderes públicos de un Estado Social como el nuestro deben promover las condiciones necesarias para cubrir dicha necesidad. Este artículo analiza la regulación en los nuevos Estatutos de Autonomía del derecho constitucional a una vivienda digna y adecuada, centrándonos concretamente en la segunda parte del artículo en el análisis de la Ley 1/2010, reguladora del derecho a la vivienda en Andalucía.

[Abstract] From the second half of the nineties there has taken place a spectacular raise of the prices of the housing. This situation has led to the impossibility of satisfaction of the social right to enjoying a housing worthy by the citizenship. The housing is a basic need of the persons and, therefore, the public power of a Social State must promote the necessary conditions to cover the above mentioned need. This article analyzes the regulation in the new Estatutos de Autonomía about the constitutional and statutory law to a worthy and suitable housing. It is done also an analysis of the Law 1/2010, regulatory from the right to the housing in Andalusia
