Abstract

[Resumen] El trabajo titulado “¿Igualdad real? La discriminación basada en la orientación sexual. Referencia especial a la jurisprudencia” examina la discriminación por orientación sexual desde una perspectiva jurídica, centrándose en los derechos humanos y el derecho antidiscriminatorio. Analiza el marco normativo internacional (DUDH, PIDCP, PIDESC, CEDH, CDFUE), europeo (Directivas 2000/78/CE y 2004/83/CE, TFUE) y nacional (Constitución Española, Ley 4/2023, ET, LISOS), destacando la jurisprudencia clave sobre igualdad y protección frente a la discriminación. A pesar de los avances normativos, el trabajo concluye que persisten desafíos estructurales que requieren políticas antidiscriminatorias más fuertes.
