Abstract

[Resumo]: Dna. Aurelia Lavandeira Goméz naceu na Coruña no ano 1931. Aos dezaoito anos mudouse a Madrid (1949), onde traballou como costureira durante décadas, coñeceu ao que foi o seu marido, e criou á súa única filla, Manuela. No ano 2010, tras o falecemento do seu marido, Dna. Aurelia outorgou un testamento aberto notarial no que instituía como herdeira de todos os seus bens á súa filla Manuela. Tras anos de exercicio da súa profesión, Dna. Aurelia sufría molestias agudas nas mans, que aos poucos se foron estendendo ás súas extremidades inferiores. Ante tales problemas físicos, Dna. Aurelia decidiu regresar á súa cidade de orixe, A Coruña, onde aínda habitaba a súa familia: irmáns, curmáns, sobriños etc.; coa excepción da súa filla, residente en Madrid -e quen, por razóns de traballo, realizaba numerosas viaxes ao estranxeiro-. Desta forma, Dna. Aurelia mudouse no ano 2013 ao pequeno piso que herdara dos seus pais na Coruña. Alí, era coidada pola súa sobriña Ana, que gozaba de dobre nacionalidade: española e arxentina. Os primeiros meses, a moza ocupouse da súa tía “en corpo e alma”. Mais, co tempo, as doenzas físicas de Dna. Aurelia empeoraron, e a súa mobilidade reduciuse ata o punto de que non podía desprazarse sen axuda, negándose a empregar unha cadeira de rodas. Iso causou unha importante discusión entre Dna. Aurelia e a súa sobriña, quen se marchou de casa tras tales desavinzas. Como consecuencia, a familia de Dna. Aurelia suxeriu á anciá o seu internamento na residencia “A Mañá”. Así pois, desde o ano 2014 á 2016 Dna. Aurelia permaneceu internada na residencia indicada, onde estableceu unha gran amizade coa súa directora, Estefanía. Con todo, dous anos despois do seu ingreso, Dna. Aurelia decidiu abandonar a residencia e regresar ao seu piso na Coruña. Alí contratou a María Antonia –coñecida cariñosamente como “Toñi”-, quen lle provía coidados á muller; e a Raquel, que se ocupaba da cociña e limpeza no fogar. Ambas as mulleres, Toñi e Raquel, estableceron amizade, e de cando en vez Raquel chegou a substituír a Toñi no coidado da anciá, cando a súa compañeira tiña que ausentarse por razóns persoais. Chegado o ano 2019, Dna. Aurelia redactou de man propia o seguinte escrito: “Deixo á miña única filla Manuela o que por lexítima correspóndalle segundo o Dereito Civil común, aplicable por ser esta a miña veciñanza civil, e institúo herdeiras dos meus bens por partes iguais a Estefanía López Sánchez, directora da residencia A Mañá; a Toñi e a Raquel Méndez Suárez. Así mesmo, lego as participacións da empresa Eléctricas S.L. á miña sobriña Ana, así como un apartamento situado en Florencia. A Coruña na festividade da Asunción”. O escrito ten ao pé a sinatura co nome de Dna. Aurelia e o apelido Lavandeira. No ano 2024, á idade de 93 anos, Dna. Aurelia falece no seu piso da Coruña. A súa familia atopa o escrito realizado pola anciá no ano 2019. Despois dun longo proceso, as herdeiras pretenden recoñecer a sentenza española en Italia e darlle forza executiva. Ao recibir a sentenza, o tribunal italiano procede á súa revisión e considera que a cualificación que fixo o tribunal español, en canto á consideración de lexítimas herdeiras, non se axusta ao dereito italiano, polo que non procede a execución da sentenza española.

[Abstract]: Aurelia Lavandeira Goméz was born in A Coruña in 1931. At the age of eighteen she moved to Madrid, where she worked as a dressmaker for decades and met her husband. Also in this city, Aurelia brought her sole daughter (Manuela) up. In 2010, after the death of her husband, Aurelia executed a notarial will in which she appointed her daughter Manuela as the heir of all her assets. After years of practising her job, Aurelia suffered a sharp ache in her hands, which gradually spread to her lower limbs. Faced with such physical problems, Aurelia decided to return to her city of origin, A Coruña, where her family still lived: siblings, cousins, nephews, etc.; with the exception of her daughter, who lived in Madrid. Manuela, for work reasons, made several trips abroad. Thus, Aurelia moved in 2013 to the small flat she had inherited from her parents in A Coruña. There, she was cared for by her niece Ana, who had dual nationality: Spanish and Argentinean. For the first few months, the young woman took care of her aunt ‘body and soul’. However, over time, Aurelia's physical pains worsened, and her mobility was reduced. In particular, she could not move around without assistance. Moreover, she refused to use a wheelchair. This caused a major argument between Aurelia and her niece, who left home after such disagreements. As a result, Aurelia's family suggested to the elderly woman that she could be hospitalized in “La Mañana” nursing home. Hence, from 2014 to 2016, Aurelia remained in the residence, where she developed a close friendship with its director, Estefanía. Nevertheless, two years after her admission, Aurelia decided to leave the nursing home and return to her flat in A Coruña. There she hired María Antonia -affectionately known as ‘Toñi’- who provided care for Aurelia. The elderly woman also hired Raquel, who was in charge of the cooking and cleaning in the home. The two women, Toñi and Raquel, became friends, and occasionally Raquel replaced Toñi in the care of the old woman, when her colleague had to be absent for personal reasons. In 2019, Aurelia drew up the following document in her own handwriting: ‘I leave to my only daughter Manuela what by legitimate right corresponds to her according to Common Civil Law, applicable because this is my civil neighbourhood. Also, I appoint as heirs of my assets in equal shares: Estefanía López Sánchez, director of La Mañana nursing home; Toñi; and Raquel Méndez Suárez. I also bequeath the shares of the company Eléctricas S.L. to my niece Ana, as well as a flat in Florence. A Coruña on the feast of the Assumption’. At the bottom of the document is a signature with the name ‘Aurelia’ and the surname ‘Lavandeira’. In 2024, at the age of 93, Aurelia died in her flat in A Coruña. Her family found the writing made by the old woman in 2019. After a long judicial process, the heirs sought to have the Spanish judgment recognised in Italy and make it enforceable. Upon receipt of the judgment, the Italian court reviewed it and considered that the Spanish court's classification of the heirs as forced heirs was not in accordance with the Italian law. Therefore, the Spanish judgment could not be enforced
