Abstract

[Resumen]: En este trabajo se desarrollan varias cuestiones relacionadas con una de las mayores preocupaciones existentes en España, la problemática del acceso a la vivienda y varios temas relativos al derecho a la propiedad y a la posesión de un bien inmueble, como son el desahucio, los derechos y obligaciones de los arrendadores y arrendatarios, así como la eliminación de barreras arquitectónicas de acceso a los inmuebles. Asimismo, se analizan los trámites de los juicios verbales del desahucio desde el punto de vista del arrendador y arrendatario, teniendo en cuenta la última normativa en la materia, como es el caso de los diferentes Reales Decretos Ley surgidos en época de la pandemia del Covid en aras a paralizar los lanzamientos de los desahucios, en caso de vulnerabilidad, prorrogados hasta el 31 de diciembre de 2024. En otro orden, se analizan la normativa y competencias en materia de vivienda, desde el punto de vista de las diferentes Administraciones Públicas (Local, Autonómica y Estatal), con especial referencia a las viviendas de uso turístico. Para poder alcanzar una conclusión se ha intentado desarrollar todos los aspectos desde una perspectiva objetiva, pero teniendo en cuenta que la vivienda es base de estabilidad y seguridad para las personas y sus familias. El alza de los alquileres y el escaso mercado de la vivienda es un grave problema al que se enfrenta la sociedad española, lo que hace que aumente la intervención de los poderes públicos para su regulación.

[Abstract]: This work develops serveral issues related to one of the major concerns in Spain, the problem of Access to housing and several issues related to the right to ownership and possession of a property, such as eviction, the rights and obligations of landlords and tenants, as well as the elimination of architectural barriers to Access to the same. It also analyses the formalities of verbal eviction trials from the point of view of the landlord and tenant, taking into account the latest regulations on the subject, such as the different Royal Decree Laws that arose during the Covid pandemic in order to paralyse evitions in cases of vulnerability, which have been extended until 31 of December 2024. In another area, the regulations and competences in the field of housing are analysed, from the point of view of the different public administrations (local, regional and national), with special reference to housing for tourist use. In order to reach a conclusion, an attempt has been made to develop all aspects from an objetive perspective, but bearing in mind that housing is the basis of stability and security for people and their families. The rise in rents and the scarce housing market is a serious problem facing Spanish society, which has led to an increase in the intervention of the public authorities to regulate it.
