Abstract

[Resumen] Como es bien sabido, la agresión rusa contra Ucrania ha tenido un gran impacto en el desarrollo del derecho internacional público y de la Unión Europea durante este año. Algunas de sus principales consecuencias son bien conocidas y ya han recibido considerable atención doctrinal, como las diversas y graves cuestiones planteadas en el ámbito del Derecho Internacional Humanitario, los múltiples paquetes de medidas restrictivas impuestos por la Unión Europea ante la ausencia formal de un régimen específico de sanciones del Consejo de Seguridad de las Naciones Unidas, etc. Sin embargo, existe otra dimensión de esta guerra que requiere un análisis propio y que, en algunos casos, ha pasado desapercibida para la doctrina: los movimientos geoestratégicos y los desarrollos jurídicos que el contexto bélico ha propiciado en algunos de los llamados «conflictos congelados» entre los Estados, derivados del desmembramiento de la antigua Unión Soviética, en los que la Unión Europea apenas había intervenido, como el conflicto de Nagorno-Karabaj. El presente trabajo, precisamente, tiene como objetivo visualizar y analizar la posición que la Unión Europea ha venido definiendo respecto al conflicto de Nagorno-Karabaj, a través de la adopción de textos de distinta naturaleza por uno de sus principales órganos, que es el Parlamento Europeo.

[Abstract] As is well known, the Russian aggression against Ukraine has had a great impact on the developments of public international law and of the European Union during this year. Some of its main consequences are well known and have already received considerable doctrinal attention, such as the various and serious issues raised in the field of International Humanitarian Law, the multiple packages of restrictive measures imposed by the European Union in the formal absence of a specific regime of sanctions of the Security Council of the United Nations, etc. However, there is another dimension of this war that requires its own analysis and that in some cases has gone unnoticed by the doctrine, and it is none other than the geostrategic movements and legal developments that the war context has fostered on some of the so-called " frozen conflicts” between the States arising from the dismemberment of the former Soviet Union, in which the European Union had barely played a role, such as Nagorno- Karabakh conflict. The current work, precisely, has the objective to view and analyze the position that the European Union has been defining in regard to the Nagorno-Karabakh conflict, through the adoption of texts of a different nature by one of its main bodies, which is the European Parliament.

[Resumo] Como é ben sabido, a agresión rusa contra Ucraína tivo un grande impacto no desenvolvemento do dereito internacional público e da Unión Europea este ano. Algunhas das súas principais consecuencias son ben coñecidas e xa recibiron unha considerable atención doutrinal, como as diversas cuestións graves suscitadas no ámbito do dereito internacional humanitario, os múltiples paquetes de medidas restritivas impostas pola Unión Europea en ausencia formal dun réxime específico de sancións do Consello de Seguridade das Nacións Unidas, etc. Non obstante, existe outra dimensión desta guerra que require a súa propia análise e que, nalgúns casos, pasou desapercibida para a doutrina: os movementos xeoestratéxicos e os desenvolvementos xurídicos que o contexto bélico fomentou nalgúns dos chamados "conflitos conxelados" entre estados derivados do desmembramento da antiga Unión Soviética, nos que a Unión Europea apenas interviña, como o conflito de Nagorno-Karabakh. Este traballo ten como obxectivo visualizar e analizar a posición que a Unión Europea foi definindo con respecto ao conflito de Nagorno-Karabakh, mediante a adopción de diversos textos por parte dun dos seus principais órganos, o Parlamento Europeo.
