[Resumen]: En el presente trabajo se abordan dos decisiones fundamentales que los tribunales CIADl deben adoptar para poder conocer del fondo de un asunto: la decisión sobre jurisdicción y la decisión sobre admisibilidad. En la primera, se deben verificar una serie de presupuestos procesales a la luz del Convenio CIADI, pero también de los tratados de inversiones en que se contenga la cláusula de arbitraje. En la segunda, se trata de decidir, tras una evaluación prima facie, si los hechos que dan lugar al litigio están protegidos por un tratado de inversiones. Se ha tratado de realizar una enumeración exhaustiva de los presupuestos procesales que se han de evaluar, apuntando a los problemas que se han dado en la práctica y proponiendo soluciones a los mismos .
[Abstract]: This tudy tackles two fundamental decisions that ICSID tribunall have to cope with before deciding on the merits of the case: the decision on jurisdiction and the decision on admissibilíty. In the first one, a number of procedural requirements must be assessed, in the light of the Convention, but also in the light of the investment treaty where the arbitration offer is enclosed. In the second decision, the tribunal must decide, after a prima facie evaluation, if the facts from which the dispute arises are protected by the investment treaty. It is the intention of the present work to enlist in detail the procedural requirements that have to be assessed, pointing at the problems which have arose in the practice and suggesting solutions to them.
