Abstract

[Resumen]: Este artículo aborda una de las cuestiones fundamentales del análisis económico del campo punitivo: la influencia de las crisis económicas sobre el delito y la penalidad. Las crisis económicas ni producen necesariamente un incremento de la delincuencia (al menos no de todas las tipologías de delito) ni generan siempre un aumento de la punitividad. De forma más específica, los estudios empíricos sobre el efecto de las diversas crisis económicas (la Gran Depresión, la crisis de los años 70 o la reciente Gran Recesión) muestran un panorama ambiguo en materia de evolución de la delincuencia y de la penalidad. El artículo aborda esta materia en su complejidad. Por una parte, analiza el debate académico sobre la influencia de las crisis económicas y de sus efectos más relevantes (como el incremento del desempleo) sobre la penalidad. Por otra, el texto se aproxima al estudio de caso más novedoso: la evolución de la punitividad y de la delincuencia en el contexto de la Gran Recesión iniciada en 2007-2008.

[Abstract]: The influence of economic crises on crime and penality is one of the fundamental issues in economic analysis of the punitive field, and the topic has been explored from various perspectives in a wide range of criminology theories. Economic crises do not necessarily produce an increase in crime (at least not in all types of crime), nor do they always lead to an increase in punitiveness. Indeed, empirical studies about the effect of diverse economic crises (the Great Depression, the oil crisis of the 1970s, and the recent Great Recession) reveal an ambiguous panorama of the evolution in crime and penality. The impact of economic turmoil on crime and punishment should be examined in all its complexity. This article explores at the outset the relation between economic crises and crime, and then examines the relation between economic crises and penality. Subsequently, it details the effect of the recent Great Recession on both crime and punishment. Title: Economic crises, crime, and penality
