[Resumen] Los tribunales de justicia comunitarios, como el Tribunal deJusticia de la Comunidad Andina o el de la Unión Europea,tienen asignada, entre otras, la función esencial de garantizarque las normas comunitarias se interpretan y aplican demanera uniforme en el territorio de los países miembros. Estafunción se desarrolla a través de la competencia prejudicial, envirtud de la cual se establece un diálogo judicial entre el jueznacional (juez a quo) que plantea una duda de interpretación ode validez al juez comunitario (juez ad quem) sobre una normacomunitaria que debe aplicar. Este diálogo judicial planteamuchas incógnitas derivadas de la inexistencia de un conceptocierto de «juez nacional». El objeto de este trabajo se centra,en particular, en ver cómo se ha ido abriendo paso el arbitrajedentro de este diálogo judicial, haciendo hincapié en laconfiguración de esta institución por parte del Tribunal deJusticia de la Comunidad Andina, anticipando líneas dereflexión para su futuro desarrollo.
[Abstract] Community courts of justice, such as the Court of Justice ofthe Andean Community or the Court of Justice of the EuropeanUnion, are assigned, among others, the essential function ofguaranteeing that community law rules are interpreted andapplied uniformly in the territory of the member States. Thisfunction is developed through the preliminary ruling,establishing a judicial dialogue between the national judge(judge a quo) who raises a doubt of interpretation or validity to the community judge (judge ad quem) on a communitynorm that he must apply. This judicial dialogue raises manyunknowns derived from the absence of a determined conceptof “national judge”. The purpose of this work focuses, inparticular, in seeing how arbitration has made its way withinthis judicial dialogue, emphasizing the configuration of thisinstitution by the Court of Justice of the Andean Community,anticipating lines of reflection for its future development.
