[Resumen] El presente artículo revisa el tratamiento normativo yjurisprudencial del mecanismo procesal de control delegalidad de los actos comunitarios en la Comunidad Andina:la acción de nulidad, de competencia del Tribunal de Justiciade la Comunidad Andina. El trabajo aborda cómo estáregulada la acción de nulidad en el Tratado de creación delTribunal supranacional y su Estatuto, y se compara sunaturaleza jurídica con otros mecanismos procesales queconoce la corte andina. Con ello, se procede a comparar laacción de nulidad andina con otras figuras jurídicas similaresen el derecho español y europeo. Finalmente, se recopilandistintos desarrollos jurisprudenciales del Tribunal de Justiciade la Comunidad Andina que brindan mayores luces sobre elfuncionamiento real de la acción de nulidad en el sistemajurídico de la Comunidad Andina.
[Abstract] This paper reviews the normative and jurisprudential treatmentof the procedural mechanism of legality control in the AndeanCommunity: the annulment action in the jurisdiction of theCourt of Justice of the Andean Community. The work asseshow the annulment action is regulated in the Tribunal CreationTreaty and its Statute and compares its juridical nature withother procedural mechanisms that the Andean court examines.That said, it compares the annulment action with other similarjuridical figures in Spanish and European law. Finally, thearticle compiles a diverse group of jurisprudentialdevelopments of the Andean Community Court of Justice to analyze more deeply how the annulment action functions inthe Andean community law.
