The Spanish statute on the right to adequate housing and the subjective right to adequate housing)
Authors: Busto Lago, José Manuel;

Abstract

[Abstract] Despite its name, the Spanish statute 12/2023 of 24 May, does not come to legally recognize a right to adequate housing, so that it cannot be understood as the means to comply with the European Parliament resolution of 21 January 2021 on access to decent and affordable housing for all. Therefore, one cannot say, as a result of the new legislation, that this right is now guaranteed in Spain; although it is a right which was qualified as fundamental by ECJ decision of 10 September 2014 (case C-34/13; Monika Kušionová y SMART Capital, a.s.). The new Spanish legislation does not allow to exercise the right to adequate housing against the State, although it formally declares that all have "the right to enjoy an adequate and decent home, according to the terms of this statute" (art. 8.1 of statute 12/2023). On the contrary, the statute is designed as a legal toolbox for the Spanish public administration to reach the goals defined in its policy plans. At the same time, it sets up some limitations to the real estate owners (especially in the case of the so-called «big land owners»). These limitations are linked to the duty of the owners to dedicate their houses only for residential purposes and to protect the tenants in the event that they fall into a situation of economic vulnerability.
