El descuelgue del convenio colectivo

Abstract

[Abstract] In Spanish labor law, the non-application of the working conditions regulated in a statutory collective agreement (that is, the collective agreement applicable to all companies and workers included in its scope of application) is a safety valve aimed at to avoid that, due to the application of these 46 DOUTRINA RGDS (16, 2022)conditions to a company in a negative economic situation or affected by technical, organizational or productive causes, jobs are lost and even the company is closed. This study analyzes the agitated evolution of the norms that regulate the non-application of statutory collective agreements, their legal nature and distinction with related figures, the collective agreements that may be affected, the working conditions that may be affected and the causes that cause it justify, as well as the negotiation procedure to reach an agreement of non application, the systems to resolve the disagreement, and its judicial control.

[Resumen] En el derecho laboral español, el descuelgue (o inaplicación) de las condiciones de trabajo reguladas en un convenio colectivo estatutario es una especie de válvula de seguridad encaminada a evitar que, por la aplicación de esas condiciones a una empresa en situación económica negativa o afectada por causas técnicas, organizativas o productivas, se pierdan puestos de trabajo e incluso se cierre la empresa. Este estudio analiza la agitada evolución de las normas que regulan el descuelgue de los convenios colectivos estatutarios, su naturaleza jurídica y distinción con otras figuras afines, los convenios colectivos que pueden verse afectados, las condiciones de trabajo que pueden verse afectadas y las causas que justifican la no aplicación, así como el procedimiento de negociación para llegar a un acuerdo de descuelgue y los sistemas para resolver el eventual desacuerdo, y su control judicial.

[Resumo] No dereito laboral español, o descolgue (ou inaplicación) das condicións de traballo reguladas nun convenio colectivo estatutario é unha especie de válvula de seguridade encamiñada a evitar que, pola aplicación desas condicións a unha empresa en situación económica negativa ou afectada por causas técnicas, organizativas ou produtivas, se perdan postos de traballo e mesmo se peche a empresa. Este estudo analiza a axitada evolución das normas que regulan o descolgue dos convenios colectivos estatutarios, a súa natureza xurídica e distinción con outras figuras afíns, os convenios colectivos que poden verse afectados, as condicións de traballo que poden verse afectadas e as causas que xustifican a non aplicación, así como o procedemento de negociación para chegar a un acordo de descolgue e os sistemas para resolver o eventual desacordo, e o seu control xudicial.
