[Resumen]SE REALIZA EN LA TESIS DOCTORAL LA DELIMITACION DE LOS DERECHOS E INTERESES PROTEGIDOS A TRAVES DE LA ACCION DERIVADA DEL ART. 1902 DEL CODIGO CIVIL. SE FUNDAMENTA EN NUESTRO DERECHO POSITIVO EL REQUISITO DE LA ANTIJURICIDAD, EXPLICANDO LAS CONSECUENCIAS JURIDICAS QUE CONLLEVA SU EXIGENCIA. SE EXAMINA LA TUTELA DE LOS DERECHOS DE CREDITO Y DE LA SITUACION POSESORIA, ASI COMO LA RESARCIBILIDAD DE LOS INTERESES LEGITIMOS, EN ESPECIAL LOS DEL CONVIVIENTE POR LA MUERTE DEL OTRO CONVIVIENTE. LA TESIS SE COMPLETA CON EL ANALISIS DE LA INFLUENCIA DE LAS CAUSAS DE EXCLUSION DE LA ANTIJURIDICIDAD, TANTO EN LA R.C. COMO EN LA LLAMADA R.C. "EX DELICTO".
