[Resumen] Este proyecto tiene como cometido fundamental realizar un análisis exhaustivo del servicio de asesoramiento financiero prestado en España. Dicho servicio ha sufrido un cambio radical motivado por la grave crisis financiera iniciada en 2007 y por la aparición de un tsunami regulatorio sin precedentes a nivel nacional y europeo. Nos centraremos en el estudio de la normativa MIDIF I (Markets in Financial Instruments Directive), responsable del reconocimiento del asesoramiento financiero como un servicio de inversión de primer nivel y de la creación de las EAFI (Entidades de Asesoramiento Financiero Independiente), llamadas a ser el futuro del sector financiero. A continuación nos detendremos en las principales modificaciones que traerá consigo MIDIF II, cuya aplicación práctica en España se estima para enero de 2017. La principal novedad será la prohibición del cobro de incentivos a aquellas ESI (Entidades de Servicios de Inversión) que se califiquen de independientes, lo cual obligará a todas las entidades a enseñar sus cartas. Seguidamente nos centraremos en la figura de las EAFI, en sus principales características y en su evolución reciente, finalizando el trabajo con una comparativa entre el asesoramiento que prestan las entidades de crédito y el dispensado por las EAFI.
[Abstract] This dissertation has a main objective to realize a deep analysis of the financial advice service offered in Spain. This service has suffered a radical change as consecuence of the serious financial crisis started in 2007 because of the regulative tsunami without precedents in the national and European scene. We will focus on the investigation of the normative MIDIF I (Markets In Financial Instruments Directive), responsible of the recognition of the Financial advice as invest service and the creation of the EAFI (Entities of Financial Independent Advice -EFIA), calls to being the future of the Finantial sector. Then we will detain in the main modification that it will bring with it MIDIF II, whose application in Spain is estimated for January, 2017. The principal innovation will be the prohibition to charge incentives to those entities of service of investment that are qualified or independent, that force to all entities to show their letters. Immediately after, we will centre on the EFIA figure, on their principal characteristics, and on their recent evolution, finishing the dissertation with the comparation between the advice given by the credit institution and the advice offered by EFIA.
