[Resumen] Este trabajo analiza las cuatro reformas operadas, durante la actual crisis económica, en el texto del artículo 41 del Estatuto español de los Trabajadores. Pone de relieve, entre otras cosas, que se trata de reformas inconstitucionales o que violan el Derecho de la Unión Europea. En definitiva, se coloca al trabajador ante la disyuntiva «lo tomas o lo dejas», ante la modificación sustancial injustificada de sus condiciones de trabajo.
[Abstract] This work analyzes the four amendments operated, during the current economic crisis, in the text of article 41 of the Spanish Workers’ Statute. It points out, among other things, that they are amendments violating the Spanish Constitution or the Law of the European Union. In conclusion, the worker is placed before the dilemma «take it or leave it», in front of the unjustified substantial modification of his working conditions.
