Abstract

[Resumen] Este trabajo analiza el trascendental cambio ocurrido en la competencia territorial de los tribunales laborales españoles, tras la promulgación de la Ley 13/2009, luego recogido por la vigente Ley 36/2011, Reguladora de la Jurisdicción Social. Este cambio ha consistido en asimilar la competencia territorial a los demás supuestos de competencia delimitadores de la jurisdicción de nuestros tribunales laborales, al hacer posible la apreciación de oficio de su falta por parte de estos últimos. Se rompe así con una tradición en España de más de un siglo, según la cual cabía el pacto de sumisión (primero, expreso y tácito; luego, sólo tácito) acordado entre empresario y trabajador, al efecto de someter sus litigios a un determinado tribunal laboral, precisamente porque este último no tenía el poder de apreciar de oficio su propia falta de competencia territorial. El trabajo analiza los diversos supuestos de fuero electivo y de fuero único, que permiten delimitar la competencia territorial de nuestros tribunales laborales. También analiza, aprovechando la jurisprudencia laboral anterior a la promulgación de la Ley 36/2011, la tramitación procesal de las cuestiones de competencia territorial, tanto en la instancia como en vía de recurso.

[Resumo] Este traballo analiza o trascendental cambio ocurrido na competencia territorial dos tribunais laborais españois, tras a promulgación da Lei 13/2009, logo recollido pola vixente Lei 36/2011, Reguladora da Xurisdicción Social. Este cambio consistiu en asimilar a competencia ós demáis supostos de competencia delimitadores da xurisdicción dos nosos tribunais laborais, facendo posible a apreciación de oficio da súa falta por parte destes últimos. Rómpese así unha tradición en España de máis dun século, segundo a cal cabía o pacto de sumisión (primeiro, expreso e tácito; logo, so tácito) acordado entre empresario e traballador, ó efecto de someter os seus litixios a un determinado tribunal laboral, precisamente porque este último non tiña o poder de apreciar de oficio a súa propia falta de competencia territorial. O traballo analiza os diversos supostos de fuero electivo e de fuero único, que permiten delimitar a competencia territorial dos nosos tribunais laborais. Tamén analiza, aproveitando a xurisprudencia laboral anterior á promulgación da Lei 36/2011, a tramitación procesual das cuestións de competencia territorial, tanto na instancia como en vía de recurso.

[Abstract] This dissertation analyses the trascendental change occurred on the venue of the Spanish labor courts, after the enactment of the Act 13/2009, which was then enbodied by the Act 36/2011, Ruling the Social Jurisdiction, nowadays in force. This change implies to assimilate the venue to the rest of competence types marking the jurisdiction of our labor courts, in making possible to declare without exception its fault by the own labor courts. So, a tradition ruling more than a century has been broken in Spain. According to such tradition, the convenant of submission (firstly, express and implied; then, only implied) agreed between employer and worker was possible, with the goal of litigating under a specific labor court, because the latter did not have the power to declare its own fault of venue. This dissertation analyses the several kinds of the choice jurisdiction and unique jurisdiction, which permit to mark the venue of our labor courts. It also analyses, using the labor case-Law existing before the enactment of the Act 36/2011, the proceeding of venue questions, not only in the first intance, but also in the appeals.
