Abstract

Il diritto penale è strettamente collegato al linguaggio scritto. Per questa ragione, l’evoluzione del linguaggio è l’evoluzione del diritto. Il giudice penale non può applicare la legge in malam partem superando il suo significato letterale. Ciò conferma la funzione garantistica della forma. Il difetto maggiore degli approcci antiformalistici è la mancanza di limiti prestabiliti all’atto interpretativo.
