The purpose of the research is to analyze how the latest constitutional changes that have happened in Latin-American countries break with the constitutional thought of European origin and its respective liberal State model. The Constitutions of Venezuela (1999), Ecuador (2008), and Bolivia (2009), met the demands of ethnic groups historically oppressed and excluded from political participation – both active and passive – by the European model, state-centered and monocultural. Thus, they proposed a re-founding of the state, through a plurinational model, wherein the ethnic and cultural diversity of Latin-American peoples is recognized. The aim therefore is to overcome the political and legal apparatus forged by European modernity which is completely at odds with Latin-American experience. This is presented as a cogent stage for the recognition of groups deliberately ignored by previous Constitutions, as these political and legal changes appear to promote the elimination of a traditional framework of inequality in the participation in democratic decision-making process. It even includes changing the legal system, hitherto monopoly of the state. To accomplish this task, the pattern of European state will be reconstructed, through the analysis of previous Constitutions and its respective constitutional doctrines. Then the new Plurinational State, now endogenous, arising from the Latin-American reality will be compared. It is the intention of this research to determine to what extent this new model can achieve its aim of overcoming the state model forged by European modernity. DOS SIGLOS DE CONSTITUCIONALISMO EN AMÉRICA LATINA: UN ANÁLISIS DIACRÓNICO ENTRE EL CONSTITUCIONALISMO DEL SIGLO XXI Y EL NUEVO CONSTITUCIONALISMO LATINOAMERICANOMO DO SÉCULO XIX E NOVO CONSTITUCIONALISMO LATINO-AMERICANO Resumen: El propósito de este trabajo es analizar cómo los últimos cambios constitucionales ocurridos en los países latinoamericanos rompen con el pensamiento jurídico-constitucional europeo y el respectivo modelo de Estado liberal, heredado de las metrópolis cuando eran independientes. Como las Constituciones de Venezuela (1999), Ecuador (2008) y Bolivia (2009), que, tomando en cuenta los reclamos de etnias históricamente oprimidas y excluidas de la participación política --activa y pasiva-- por un modelo estatal con matriz europea, proponen la refundación del Estado, a través de un modelo plurinacional, en el que se reconozca la diversidad étnica y de identidad cultural de los pueblos latinoamericanos. La superación de un aparato político-legal forjado por la modernidad europea y, por tanto, totalmente desvinculado de la experiencia de los pueblos latinoamericanos, se presenta como un paso contundente para el reconocimiento efectivo e inclusión de grupos deliberadamente desatendidos por las anteriores Cartas Constitucionales de matriz liberal, ya que estas transformaciones político-legales parecen promover la extinción de un marco tradicional de desigualdad en la participación del proceso democrático de toma de decisiones y también en el sistema legal, hasta entonces monopolio del "Estado". Para llevar a cabo este enfoque, se reconstruirá el modelo político-jurídico estatista de origen europeo, a través del análisis de las Constituciones anteriores y las respectivas doctrinas constitucionales, para luego oponerse al nuevo modelo de Estado plurinacional, ahora endógeno, surgido de la realidad fáctica latinoamericana. Se pretende, por tanto, comprobar hasta qué punto este nuevo modelo, como teorización, rompe con el modelo estatal y monocultural forjado por la modernidad europea y, por tanto, se presenta como una alternativa al pensamiento jurídico “tradicional”.
